MMI CSI: Medical Case

International Medical University, Selangor, 22 February 2020 – In a medico-legal event organised by MMI Malaysia on 22 February 2020 – ‘CSI: Medical Case’, Dr Arulalan Kumaran, Director of Policy and International Relations Division, Malaysian Medical Council (MMC), graced our stage by giving a brief introduction on MMC and the relevant medical regulation acts governing our doctors. On sharing some statistics on registration of house officers (HOs), he says “every year 2000 HOs will dropout after two years of HO.” The extension rate mentioned was a whopping 32.9% of those who dropped out. Amongst items discussed, a new code of professional conduct will also be released on 1 April 2020. 

On further discussion about legal cases, Dr Sharizan Shaharuddin, who is the Chief Medical Officer of MiyaHealth  stressed that MMC is not involved in determining a doctor’s negligence, it is the court that decides whether the doctor should retain their right to practice. 

“There is a 6-year grace period to sue a doctor while a complaint can come anytime.” Dr Sharizan stated. She adds that it is the government’s responsibility to respond to a court case should the hospital be sued. 

After Dr Arulalan and Dr Sharizan’s insightful talks, a series of debates were held. 12 medical students from the Language Educator and Debating Society from Royal College of Medicine, Perak debated on two motions: should live donor be rewarded financially and should undocumented immigrants get health care in fulfilling the medical care for all system. On discussion about live donor organs, Dr Mark Tan Kiak Min, a lecturer in Medical Ethics and Law, Universiti Teknology MARA (UiTM), mentions that ‘it shall not be questioned as it is stated in the law that live donors donate organs on a voluntary basis’. Therefore, donors are not to be rewarded financially for their donated organs.

The event was proceed by 6 workshops in the afternoon, topics covered in the workshops were sexual violence, becoming a medical lawyer, expert witness, forensic medicine, medical negligence and child abuse. 

It was an eventful day for our participants and we hope that our participants have gained a lot from this event.
